This Policy applies to personally identifiable personal information ("Personal Information") that we collect when you visit our web site, shop in one of our store(s), or otherwise interact with us (e.g., placing an order by phone or contacting customer service). This Policy also applies to any Personal Information that we may receive in the future from our business partners and third-party sources. Personal Information under this Policy is information that we directly associate with a specific person - such as the person's name, address, phone or fax number, email address, credit card information, etc.). Our definition of Personal Information does not include "aggregated" information – data that we collect about a group or category of people that does not contain any personally identifiable information.

What We Collect

We collect Personal Information about you as a normal course of business - when you use our web site, shop in our store(s), or otherwise interact with us. Some of this Personal Information is volunteered by customers (e.g., during a purchase, when setting up for an online account, or when signing up for our e-mail newsletter). We also collect certain types of Personal Information automatically, whenever you use our services. For example, when your web browser accesses our site, we obtain certain types of Personal Information, such as your IP address, the type of browser you use, and the referring page you visited just prior to visiting our site.

How We Use It

We may use the Personal Information that we collect for a variety of purposes, including but not limited to:

  • Providing materials by mail or e-mail.
  • Processing your orders for products and services.
  • Delivering products and services, as well as billing for them.
  • Offering new products and services.
  • Keeping a record of our interactions with you.
  • Providing notice of unauthorized access or other invasions of certain security systems, as required by law.
  • To facilitate certain legal processes and/or to comply with state or federal laws.

Disclosure of Personal Information

Except as specifically described in this Policy, it is Brownwood Farms’ standard business practice to not disclose Personal Information about you without your consent. We may disclose Personal Information about you with your specific consent, obtained via (1) a form or agreement; (2) online through "click-through" agreements or registration pages; (3) verbally; or (4) when your consent is part of the terms and conditions through which we provide you a particular product or service. We may disclose Personal Information to specific third parties who complete transactions or perform services on our behalf, transactions on your behalf, or transfers related to providing products to you. We may also disclose personal information in order to comply with the law; to enforce or apply any contracts or agreements; to initiate, render, bill, and collect for products or services; to protect our rights or property; in connection with claims, disputes, or litigation; or to protect ourselves and our customers from the harmful acts of others (e.g., theft, fraud, or abuse).

Cookies and Similar Technologies

We may use "cookies" and/or other Internet-based tracking mechanisms to support the buying process on our web site, to retain site changes that you direct us to make (e.g., if you personalize a page), and to learn about your possible interests so that we may better market to you. A "cookie" is a small data file that our web site transfers to your computer for storage, to allow our servers to "recognize and remember" specific Personal Information. We also use cookies and/or similar mechanisms for typical business purposes such as administering our site, tracking and analyzing visitor traffic so that we can adjust the site, and advertising/promoting our products and services. Our cookies and other tracking mechanisms may collect the following: your domain name, the name of your Internet service provider; the Internet address of the site from which you came; the date and time of your access; and your computer's IP address; and information about its operating system and browser. These technologies help us to combat fraud or misuse and to remember things like: (1) facts you tell us about yourself, (2) your specified areas of interest on our web site, (3) the items you've placed in your shopping basket, and (4) the pages you visit when you shop with us. You can disable some Brownwood Farms cookies, but our web site won't necessarily function as designed (e.g., cookies must be enabled to set up an account, access an account, or make online purchases). We may also allow the collection by analytic service provider(s) of aggregated click-stream and cookie data, in order to help us understand the overall use of our web site.

Retaining Personal Information

In some cases, we may keep Personal Information for as long as we think is necessary or advisable, to the full extent not prohibited by law. We may discard Personal Information in our discretion as well, so be sure to retain your own records. When it is not feasible or advisable to discard Personal Information (such as commingled personal information), we reserve the right to retain it but treat it as inactive or discarded. You may make a request for us to update Personal Information that is eligible for updating by contacting our Customer Service department via email, telephone, or mail.

The Security of Your Personal Information

Brownwood Farms and its affiliates take physical, electronic, and procedural measures to protect Personal Information from unauthorized access, use, or disclosure while it is under our control. Brownwood Farms employs Secure Sockets Layer (SSL) technology to encrypt during transmission the payment card personal information you input when placing an order on our web site. SSL is a commonly employed method of encrypted communication used on the Internet. Except for those transmissions, you should assume that our site is not encrypted. Email communications and online chats are not encrypted, so do not include sensitive personal information in them. An important part of ensuring the security of personal information is your personal, ongoing effort to protect it against unauthorized access or use. Choose wisely when setting up a Brownwood Farms account password. Protect the security of that account password. Do not give your password to anyone else unless you intend for them to have full and complete access to the Personal Information stored within your Brownwood Farms account. Change your password periodically. At any time, if you believe personal information about you within our control has been accessed by unauthorized persons, please contact us immediately.

Other Applicable Terms

This Policy does not modify or alter any applicable agreement you have or may have with Brownwood Farms. For example, our Terms of Use govern your use of our web site. If this Policy conflicts with any portion of those terms and agreements, those terms and agreements govern to the extent of the inconsistency. This Policy replaces all previous disclosures we may have provided you about our Personal Information practices. We will update this Policy if our practices change or if laws or regulations require that we change it. If we decide to disclose Personal Information in a way that is materially different from that which was stated in this Policy at the time Personal Information was collected, we will notify you by posting notice of the change on our site and on this page for a reasonable period before we implement that change and, if feasible, will give you an opportunity to opt out of the proposed use of Personal Information. We respect your privacy and are committed to affecting the policies described in this Privacy Policy. If you have any questions, comments or concerns about this Privacy Policy or about our privacy practices, please contact us directly.
